It is hereby promulgated that the Measures of Wuhan Municipality for the Administration of River Beaches have been adopted at the 117th Executive Meeting of Wuhan Municipal People’s Government on January 5, 2015, and shall be implemented as of March 30, 2015.

Measures of Wuhan Municipality for the Administration of River Beaches

 

Chapter One   General Provisions

Article 1   With a view to fully activating the overall functions and comprehensive benefits as well as strengthening the protection, utilization and administration of river beaches, these Measures are formulated in accordance with  relevant laws and regulations including the Flood Control Law of the People's Republic of China, the Regulations of the People's Republic of China on the Administration of River Courses, the Regulations of Wuhan Municipality on Urban Greening, and the Regulations of Wuhan Municipality on Integrated City Administration, and in the light of the actual situation of this Municipality.

Article 2   These Measures are applicable to the administration of the river beaches within the administrative areas of this Municipality where flood control and comprehensive environment control have been exercised.

Article 3   The competent administrative departments of water conservancy are the administrative authorities of river beaches, under which the river beach management agencies shall be responsible for the routine management of river beaches. The specific management areas of the river beach management agencies at the municipal and district levels (including Wuhan East Lake High-tech Development Zone, Wuhan Economic and Technological Development Zone, Wuhan East Lake Eco-tourism Scenic Spot and Wuhan Chemical Industry Park, the same hereinafter) shall be demarcated by the municipal competent administrative department of water conservancy before being released to the public.

The competent administrative departments of public security, city management, culture, and sports shall be in charge of the administrative work related to river beaches in line with their respective responsibilities.

Article 4   Developers shall, upon completion of the works of flood control and comprehensive environment control of river beaches, promptly organize final acceptance and go through the handover procedures for maintenance and management with the competent administrative departments of water conservancy.

Article 5   All units or individuals shall bear the obligations to protect the natural environment, landscape and facilities of river beaches, and shall have the right to dissuade whoever attempts to act against these Measures, or to report or complain about  such acts.

Article 6   The people's governments at the municipal and district levels (including Wuhan East Lake High-tech Development Zone, Wuhan Economic and Technological Development Zone, Wuhan East Lake Eco-tourism Scenic Spot and Wuhan Chemical Industry Park, the same hereinafter) shall, in line with their respective administration authority, incorporate the maintenance and management expenditure of river beaches into their fiscal budgets at the same level.

 

Chapter Two   Flood Control of River Beaches

Article 7   The construction within the management areas of river beaches shall conform to the administrative provisions and relevant planning requirements of river courses, without affecting the safety of flood control, and the procedures for approval shall be gone through according to law.Article 8   The flood control headquarters may, according to the requirements for flood control and flood fighting, require the relevant units and individuals within the river beaches to suspend or stop their activities and to remove the obstacles impeding flood discharge. In the event of refusal to remove the obstacles, the flood control headquarters may organize a forcible removal, the costs  needed shall be borne by those who have placed the obstacles.

Article 9   The river beach management agencies shall perform the safety management responsibilities in flood control, accept the supervision and administration of the competent administrative department of water conservancy, and abide by the unified command and control of the district flood control headquarters.

Article 10   The river beach management agencies shall formulate the emergency plans for flood control, and in the event of emergencies, take relevant measures in strict accordance with the emergency plans and report to the flood control headquarters and the competent administrative departments of water conservancy promptly.

 

Chapter Three   Order Management of River Beaches

Article 11   With a view to maintaining the normal order of sightseeing, the river beach management agencies shall formulate sightseeing management regulations, establish and improve their routine patrol policies and prevent uncivilized behaviors.

Article 12   The following acts are prohibited within the river beaches:

(1) carrying, selling or setting off Kongming lanterns or other inflammable articles;

(2) carrying implements under control, combustibles, explosives or others hazardous articles;

(3) engaged in unlawful assemblies, parades, demonstrations or heresies;

(4) distributing publicity materials for profit without authorization;

(5) scribbling or scratching in public places, or on public facilities or trees;

(6) posting or hanging publicity materials without authorization or without using the approved contents;

(7) splitting, urinating, defecating on the ground or throwing wastes at will; (8) incinerating leaves, garbage or other wastes;

(9) hanging or suspending articles on facilities or trees;(10) incinerating reeds, digging for asparagus, catching or harming animals without authorization;

(11) damaging landscaping or relevant facilities;

(12) polluting surrounding environment by discharging oil fumes in food and beverage operations; or

(13) other acts impacting the environment or damaging the facilities of river beaches.

Article 13   The activities like campfire or camping, or the display or hanging of slogans or banners within the river beaches shall, with the consent of the river beach management agencies, be carried out within the prescribed time limits and designated areas.

Article 14   Vehicles, with the exception of those used by the disabled, shall enter the river beaches only after obtaining the permission from the river beach management agencies.

Vehicles which enter the river beaches with permission shall travel on the specified routes and at the specified speed and park in the designated areas only.

Article 15   The river beach management agencies shall set up obvious signs in the areas where pets are prohibited.

Article 16   The river beach management agencies shall designate areas for fitness, performance or other activities within the river beaches and provide corresponding service facilities for the convenience of the citizens.

Organizers of the activities mentioned in the preceding paragraph shall register with the river beach management agencies. Organizers and participants shall follow the management of the river beach management agencies, carry out activities within the prescribed time limits and designated areas and comply with the provisions on ambient noise and safety management.Article 17   The organizers of commercial activities or large public benefit activities within the river beaches shall sign agreements with the river beach management agencies and, if required, go through the formalities for approval.

Article 18   The amusement, recreation and other service facilities installed or the exhibitions held within the river beaches shall be rationally arranged to be consistent with the function, size and landscape of the river beaches without damaging the environment. 

 

Chapter Four   Safety Management of River Beaches

Article 19   The river beach management agencies shall establish safety management systems and formulate emergency plans. In the event of emergencies, the river beach management agencies shall take actions in accordance with their emergency plans, like shutting down the river beaches temporarily, preventing visitors from entering the particular areas, and evacuating visitors, and shall report to the relevant administrative departments promptly.Article 20   The river beach management agencies shall take effective measures to ensure wind protection, fire protection and safety utilization of electric power in accordance with the relevant provisions, including the prompt disposal of dead and shaky twigs and the equipment with and periodic maintenance and replacement of fire fighting and rescuing facilities.

Article 21   The river beaches shall have rational arrangements of video surveillance facilities, with strengthened management of public security order and available emergency medical aid measures, so as to ensure the life and asset safety of visitors.Article 22   For large-scale activities to be held within the river beaches, their organizers shall sign a safety liability statement with the river beach management agencies, clarifying the time, location, content, area, requirements and relevant responsibilities of the activities to be held.

The organizers are the responsible party for the safety work. The river beach management agencies shall urge the organizers to implement safety measures and perform their safety liabilities.

Article 23   For activities of high risks to be held within the river beaches, their organizers shall report to the relevant competent departments for approval. The river beach management agencies may require the organizers to stop their activities at any time upon the change of meteorological conditions or for the purpose of ensuring the security order of the river beaches.Article 24   The amusement and recreation facilities within the river beaches which involves the personal safety of visitors may be put into use only after being accepted by the relevant competent departments, and shall be tested and maintained periodically by the persons in charge.

                                

Chapter Five   Service Assurance of River Beaches

Article 25   With a view to maintaining the cleanliness and tidiness of environment and the normal functioning of sanitary facilities, the river beach management agencies shall improve their landscaping and sanitary control and promptly dispose the wastes at the river beaches.Article 26   With the purpose of providing civilized, passionate, considerate and convenient services to visitors, the river beach management agencies shall formulate service regulations, by which their management and service staff shall abide.

Article 27   The river beach management agencies shall put up navigation maps, service signboards, warning signs and tourists’ notices within the river beaches.

 

Article 28   The river beach management agencies shall organize healthy and beneficial sightseeing or other cultural, sports, publicity or education activities aiming at publicizing the knowledge on flood control, humanity or other aspects.

Article 29   The river beach management agencies shall provide convenience to encourage and support the public to participate in the volunteer services of the river beaches.

Article 30   The river beaches shall be open every day. The shutdown of the river beaches for the reason of major repairs or preparation of large-scale events shall be reported by the river beach management agencies to the competent administrative departments of water conservancy for approval and be publicized three days in advance.

 

Chapter Six   Legal Responsibilities

Article 31   Any violations of the provisions on public security administration and road traffic control within the river beaches shall be punished by the public security organs according to law.

Article 32   Whoever commits any of the following acts shall be ordered by the law enforcement agency authorized by a competent administrative department of water conservancy to make corrections within a prescribed time limit; any offender who fails to  do so within the time limit shall be given penalties in accordance with following provisions; for any losses caused thereby, an offender shall bear the compensation liability according to law: (1) Whoever incinerates reeds or grubs asparagus without permission, or catches or harms animals within a river beach shall be fined not less than RMB 50 but not more than RMB 500;

(2) Whoever carries out an activity like campfire or camping, or displays or hangs slogans or banners within a river beach against the provisions of Article 13 under these Measures shall be fined not less than RMB 50 but not more than RMB 500;

(3) Any vehicle which enters a river beach against the provisions of Article 14 under these Measures shall be fined not less than RMB 50 but not more than RMB 500;

(4) Whoever walks a pet in the prohibited area of a river beach shall be fined not less than RMB 200 but not more than RMB 500;

(5) Whoever organizes or participates in an activity like fitness or performance within a river beach against the provisions of the second paragraph of Article 16 under these Measures shall be fined not less than RMB 100 but not more than RMB 500; or

(6) Whoever organizes a commercial or large public benefit activity within a river beach against the provisions of Article 17 under these Measures shall be fined not less than RMB 1,000 but not more than RMB 5,000.

Article 33   Any of the following acts within the river beaches shall be punished by the law enforcement agency authorized by a competent administrative department of water conservancy in accordance with relevant laws, regulations and rules:

(1) distributing publicity materials for profit without authorization;

(2) scribbling or scratching in public places, or on public facilities or trees;

(3) posting or hanging publicity materials without authorization or without using the approved contents;

(4) spitting, urinating, defecating on the ground or throwing wastes at will; 

(5) I incinerating leaves, garbage or other wastes;

(6) hanging or suspending articles on facilities or trees;

(7) attracting visitors by use of loud speakers or other means that produce noises;

(8) damaging landscaping or relevant facilities; or

(9) polluting surrounding environment by discharging oil fumes in food and beverage operations.

Article 34   Where a river beach management agency or any of its functionaries neglects duties, abuses power or engages in malpractices for personal gains during the river beach management, the relevant responsible person shall be dealt with under an accountability system or given administrative sanctions; if a crime is constituted, the criminal responsibilities shall be investigated according to law.Chapter Seven   Supplementary Provisions

Article 35   These Measures shall come into force as of March 30, 2015. The Interim Measures of Wuhan Municipality for the Administration of Hankou River Beach by Changjiang River (W.Zh.[2002]No.90) promulgated by the Municipal People’s Government on September 20, 2002 shall be repealed therefrom.
