It is hereby promulgated that the Provisional Implementing Rules of Wuhan Municipality for the Administration of Operating Services of Online Booked Taxis have been adopted at the 195th Executive Meeting of Wuhan Municipal People’s Government on October 31, 2016, and shall be implemented as of April 15, 2017.

Provisional Implementing Rules of Wuhan Municipality for the Administration of Operating Services of Online Booked Taxis 

  

Chapter I   General Provisions 

Article 1   With a view to better satisfying the diversified travel needs of the public, promoting an integrated development of the taxi industry and the Internet, regulating the operating services of online booked taxis, and ensuring the running safety and passengers' legitimate rights and interests, these Rules are formulated in accordance with the Interim Measures for the Administration of Operating Services of Online booked Taxis (Order No. 60 of Year 2016 of the Ministry of Transport, the Ministry of Industry and Information Technology, the Ministry of Public Security, the Ministry of Commerce, the State Administration for Industry and Commerce, the General Administration of Quality Supervision, Inspection and Quarantine, and the Cyberspace Administration of China, hereinafter referred to as the Interim Measures), and in the light of the actual situation of this Municipality. 

Article 2   These Rules are applicable to the operating services, supervision and administration, and other activities related to online booked taxis (hereinafter referred to as the online taxis) within the administrative areas of this Municipality. 

Article 3   Online taxi business shall be developed in an orderly way under overall planning, and standardized on the principle of preferential development of urban public transport, moderate development of taxis, quality service and differentiated operations. 

The number and operating price of online taxis are regulated by the market. 

Article 4   The municipal administrative department of transport is the competent authority of online taxis of this Municipality, and its affiliated municipal taxi administration agency shall be responsible for the administrative licensing of online taxi platforms, online taxis and drivers. 

The administrative departments of transport at the district level shall be responsible for accepting the applications for administrative licensing of online taxis and drivers, issuing licenses, exercising supervision and administration over the daily operations of online taxis, and investigating and punishing illegal acts, and are guided and supervised by the municipal administrative department of transport and the municipal taxi administration agency. 

The departments of development and reform, public security, human resources and social security, commerce, taxation, industry and commerce, quality supervision, cyberspace, and communications, the business department of the People's Bank Wuhan Branch, and other relevant departments and entities shall, in line with their respective responsibilities, perform the relevant supervision and administration work. 

  

Chapter II   Licensing Conditions 

Article 5   A platform company engaged in online taxi service shall meet the following conditions: 

(1) having a qualification for business corporation. A business corporation registered within the administrative areas of this Municipality shall obtain a business license; a business corporation registered beyond the administrative areas of this Municipality shall obtain a business license for its subsidiary within the administrative areas of this Municipality; 

(2) having an Internet platform for online taxi business, having a capacity for information data interaction and processing that is adapted to its planned business, having conditions for the legal enquiry of relevant network data information by the departments of transport, communications, public security, taxation, and cyberspace, and other relevant supervisory departments, connecting the database of its network service platform to the supervisory platform of the municipal administrative department of transport, positioning its servers in the mainland China, and having a network security management system and the technical measures for safety protection that conform to the provisions; 

(3) for electronic payment, having signed with the banks and non-bank payment institutions an agreement for payment and settlement services; 

(4) having fixed offices in this Municipality, providing service quality and management personnel for safety supervision and complaint handling as required, and having a capacity for information service and management of online taxi business in this Municipality; 

(5) having a sound management system, safety production management system and service quality guarantee system; and 

(6) other conditions as provided by laws and regulations. 

Foreign investors of online taxi business shall, beside the aforementioned conditions, comply with the provisions of relevant laws and regulations on foreign investment. 

Article 6   A vehicle to be used in online taxi business shall meet the following requirements: 

(1) that it shall be a passenger car with seven or less seats; 

(2) that it has been registered in this Municipality, and the date of application is within three years from the date of its initial registration; 

(3) that its technical performances meet the relevant standards for operation safety, and its exhaust emission meets the national standards for motor vehicle emission executed in this Municipality; 

(4) that it is installed with operation equipment complying with the national provisions; 

(5) that if fuel oil is used, the wheelbase shall not be less than 2,650mm, and the taxable value not less than RMB120,000; if new energy is used, the wheelbase shall not be less than 2,650mm and the power not less than 90kw, and in the condition of pure electric drive, a pure electric car shall have a range of not less than 200km and a plug-in (incl. extended-range) hybrid electric car shall have a range of not less than 50km; 

(6) that it is insured by the commercial compulsory insurance against traffic accidents, commercial third party liability insurance, passenger’s accident insurance and carrier's liability insurance; 

(7) that if it is owned by an individual, the vehicle owner shall obtain the online taxi driver’s license and have no other registered cruise passenger taxi (hereinafter referred to as cruise taxi) or online taxi; and 

(8) other conditions as provided by laws, regulations and rules. 

Article 7   An online taxi driver shall meet the following conditions: 

(1) having a household register or residence permit issued by this Municipality; 

(2) having a motor vehicle drivers license at or above the level of C1 issued by a public security organ, with more than 3 years’ driving experience; 

(3) not reaching the mandatory age for retirement; 

(4) having no record of traffic accident crimes, dangerous driving crimes, drug use or drunk driving, or record of 12 deducted scores due to illegal driving within the recent three consecutive scoring periods; 

(5) having no record of violent crimes; 

(6) having no record of revoking the qualification certificate for taxi driver within the recent five years prior to the date of application; and 

(7) other conditions as provided by laws, regulations and rules. 

  

Chapter III   Licensing Procedures 

Article 8   An applicant of online taxi service shall file an application to the municipal taxi administration agency along with the following materials: 

(1) an application form; 

(2) the original and photocopies of ID cards and credit certificates of investors and persons-in-charge, the original and photocopies of ID card of agent, and a power of attorney issued by the enterprise concerned; 

(3) the license of business cooperation, or if it is a subsidiary, plus the business license of the subsidiary, or if it is a foreign-invested enterprise, plus the approval certificate for foreign-invested enterprise; 

(4) the information on offices, responsible personnel and management personnel; 

(5) the identified results of online service capability, incl. certificates of Internet platform and of information and data exchanges and processing capacity, a certificate of access to relevant network data and information for the legal enquiry of supervisory departments, a statement concerning database access and server setting in China mainland, documents on network security management system and technical measures for safety protection, and the agreements signed with the banks or other non-bank payment institutions that provide payment and settlement services; 

(6) the documents on management system, safety production management system and service quality assurance system; and 

(7) other materials as provided by laws and regulations. 

The municipal taxi administration agency shall review the applications for online taxi service in accordance with the provisions of Article 5 of these Rules. If an applicant meets the conditions, it shall make a decision on licensing within 20 days as of the date of acceptance and issue an online taxi business license with a valid term of six years; if an applicant fails to meet the conditions, it shall make a decision on disapproval with the reasons stated; if, under a complicated circumstance, it cannot make a decision within the prescribed time limit, it may extend the review period appropriately and inform the applicant, but the maximum extension is ten days. 

Article 9    For vehicles to be engaged in the online taxi service, an online taxi platform company or a vehicle owner shall file an application to an administrative department of transport at the district level along with the following materials: 

(1) an application form; 

(2) the conformity certificates or the conformity marks of motor vehicle inspection, the original and photocopies of vehicle invoices, and the color photos of vehicles; 

(3) the vehicle registration certificates, driving licenses, and the original and photocopies of insurance documents; 

(4) the letter of intent for network operation signed with the platform company (not required if the vehicles are owned by the platform), or if the vehicles are owned by an enterprise, plus a business license of the enterprise, or if the vehicles are owned by an individual, plus the owners online taxi driver’s license; and 

(5) a conformity certificate issued by the platform company, which certifies that the operating equipment conforms with the provisions of the State. 

An administrative department of transport at the district level shall, according to the provisions of Article 6 of these Rules, finish preliminary examination within ten days from the date of receipt of an application. An applicant who has been verified to meet the required conditions shall go through the formalities for motor vehicle registration with the traffic administration under a public security organ, the municipal taxi administration agency shall make a decision on licensing within ten days as of the date when the vehicles are registered as online taxis, and an administrative department of transport at the district level shall, on the basis of the decision on licensing, issue a online taxi transport license to the applicant. 

Article 10   For a driver who intends to engage in online taxi service, the driver himself/herself or the online taxi platform company concerned shall file an application to the administrative department of transport at the district level along with the following materials: 

(1) an application form; 

(2) the original and photocopies of ID card or residence permit, and drivers license; 

(3) having no record of traffic accident crimes, dangerous driving crimes, drug use or drunk driving, or record of 12 deducted scores due to illegal driving within the recent three consecutive scoring periods, or record of violent crimes, or record of revoking the qualification certificate for taxi driver within the recent five years prior to the date of application; and 

(4) a recent 1-inch color registration photo. 

An administrative department of transport at the district level shall, according to the provisions of Article 6 of these Rules, finish preliminary examination within ten days from the date of receipt of an application. If an applicant meets the required conditions, the municipal taxi administration agency shall arrange appraisal on such applicant, and if he/she passes the appraisal, shall make a decision on licensing within ten days as of the date of acceptance. An administrative department of transport at the district level shall, on the basis of the decision on licensing, issue an online taxi drivers license with a valid term of three years. 

  

Chapter IV   Operation Regulations 

Article 11   An online taxi platform company who bears a carrier's responsibilities shall comply with the following provisions: 

(1) ensuring the operation safety, and taking charge of leading compensation for the safety accidents incurred during service; 

(2) establishing and implementing the service quality management system, ordering the drivers or vehicles complained frequently and with poor service to withdraw from operation, and reporting the information of the withdrawn drivers or vehicles to the municipal taxi administration agency; 

(3) establishing a service evaluation system and passenger complaints system, setting up fixed-line telephones to accept the complaints from passengers, carrying out investigation in a timely manner, and completing investigation and handling within three days as of the date of acceptance; 

(4) setting reasonably and marking clearly the service prices, and not raising the prices at will; if it is really necessary to raise the prices dynamically, a dynamic price adjustment mechanism shall be formulated and made known to the public; 

(5) posting or spraying according to its own need the signs of online taxi on the vehicles admitted to the platform, but not installing the special facilities and equipment for cruise taxis, such as taximeter, taxi light and unloaded light; 

(6) providing passengers with taxi invoices as provided by taxation authorities; 

(7) ensuring a reliable operation of the platform, and providing 24-hour uninterrupted service; 

(8) transmitting dynamic operation data in real time to the supervisory platform of the municipal administrative department of transport, and ensuring the authenticity and completeness of its data and information; 

(9) ensuring the normal use of vehicle operating equipment; 

(10) not using the network service platform to release the information that endangers social stability or other information prohibited by laws and regulations; and 

(11) performing other obligations as provided by laws, regulations and rules. 

Article 12 An online taxi driver shall abide by the following provisions: 

(a) doing businesses within the licensed business areas; 

(2) providing online taxi service in accordance with the operation service specifications and standards; 

(3) keeping the vehicle clean, tidy and intact, ensuring its operating equipment is in good conditions and networking; 

(4) taking the online taxi transport license and the online taxi driver's license along with the vehicle; 

(5) providing operational services in strict accordance with the orders generated on the service platform, without refusing service or stopping service in midway; 

(6) charging lawfully as per the provided mileage prices; 

(7) not accessing to an online taxi platform with no business license or using an vehicle with no online taxi service license; 

(8) not allowing others to operate his/her online taxi, not cruising to win businesses, and not waiting for passengers at the stops for cruise vehicles; and 

(9) performing other obligations as provided by laws, regulations and rules. 

Article 13   A passenger shall abide by the following provisions: 

(1) complying with the regulations on online taxi service, and waiting for online taxis at the agreed time and places; 

(2) complying with the electronic agreement concluded with online taxi platform operators, and paying fares as per the agreed standard and method; 

(3) not requiring drivers to violate the traffic regulations; 

(4) not carrying inflammable, explosive, toxic or other articles endangering public security; 

(5) not smoking, spitting, leaving trash or damaging the facilities and equipment in online taxis; 

(6) not taking online taxis in the event of getting intoxicated, unless with accompanying persons (guardians); and 

(7) other obligations as provided by laws, regulations and rules. 

  

Chapter V   Supervision and Inspection 

Article 14   The municipal taxi administration agency and the administrative departments of transport at the district level shall regularly carry out quality evaluation on online taxi service, and promptly publicize the basic information of business enterprises, the evaluation results of service quality, the solutions of passengers’ complaints, etc., and may, according to their administration needs, acquire lawfully the relevant data and information concerning the registration, operation and transaction of online taxi platform companies. 

Article 15   The departments of industry and commerce shall investigate and punish unlicensed operations and unfair competitions of online taxi platform companies. 

The departments of human resources and social security shall supervise the signing of labor contracts between online taxi platform companies and drivers. 

The departments of pricing shall supervise and control the service prices of online taxis, and investigate and punish illegal pricing acts according to law. 

Tax authorities shall supervise the tax payment of online taxi platform companies and drivers, and investigate and punish the relevant illegal acts according to law. 

The departments of public security, cyberspace and communications shall supervise and control the security of network and communication information, and investigate and punish according to law the online taxi platform companies whose illegal acts have been ascertained. 

Article 16   The municipal administrative department of transports shall establish and improve its supervision platform to achieve information sharing with the departments of development and reform, public security, human resources and social security, commerce, taxation, industry and commerce, quality supervision, cyberspace, and communications and with the departments of transport at the district level. The shared information includes the basic information of vehicles and drivers, operation and trading information, service quality information, passengers’ evaluation information, credit records, etc. 

Article 17   The taxi industry associations shall establish a bad credit record system for online taxi platform companies and drivers, and strengthen self-discipline. 

  

Chapter VI   Legal responsibilities 

Article 18   An online taxi platform company who violates the provisions of Items (2), (3), (5), (7), (8), (9) or (11) of Article 11 of these Rules shall be ordered by an administrative department of transport at the district level to make corrections, and be fined concurrently not less than RMB10,000 but not more than RMB30,000 for each violation. 

An online taxi platform company who violates the provisions of Items (4) or (6) of Article 11 of these Rules shall be punished by a department of pricing or taxation according to law. 

Article 19   A vehicle owner or user who violates the provisions of Items (1), (3) or (8) of Article 12 of these Rules shall be fined not less than RMB200 but not more than RMB2,000 by an administrative department of transport at the district level. 

A vehicle owner or user who, in violation of the provisions of Item (7) of Article 12, accesses to an unlicensed online taxi platform or uses an unlicensed vehicle in online taxi service shall be fined not less than RMB5,000 but not more than RMB20,000 by an administrative department of transport at the district level. 

Article 20   If, due to an illegal act, the relevant certificates of an online taxi platform company or driver are revoked or cancelled by the departments of public security, industry and commerce, quality supervision, and/or cyberspace, the municipal taxi administration agency may cancel the online taxi business license or the online taxi driver's license of such offender according to law. 

Article 21   If a driver uses an unlicensed vehicle in online taxi service, an administrative department of transport at the district level may inform the entity or sub-district office to which such offender belongs of the identity and punishment information of vehicle owner or driver. 

Article 22   The administrative punishments that shall be implemented by the competent administrative departments of taxis as provided by Articles 34, 35 and 36 of the Interim Measures shall be implemented by the administrative departments of transport at the district level. 

  

Chapter VII   Supplementary Provisions 

Article 23   These Rules shall come into effect as of April 15, 2017.
