It is hereby promulgated that the Measures of Wuhan Municipality for Entrusting the Imposition of Administrative Penalty have been adopted at the 8th Executive Meeting of Wuhan Municipal People’s Government on April 24, 2017, and shall be implemented as of July 1, 2017.

Measures of Wuhan Municipality for Entrusting the Imposition of Administrative Penalty 

  

Article 1   For the purpose of standardizing the acts of entrusting the imposition of administrative penalty, ensuring the legal and compliant exercise of officer powers by the administrative law enforcement bodies, and protecting the lawful rights and interests of citizens, legal persons and other organizations, these Measures are formulated in accordance with the Law of the People's Republic of China on Administrative Penalty and other laws, rules and regulations, and in the light of the actual situation of this Municipality. 

Article 2   An administrative law enforcement body of this Municipality who imposes administrative penalty (hereinafter referred to as “an entrusting body”) may, if really needed by work, entrust an organ or organization to exercise its statutory power of administrative penalty in accordance with the relevant laws, regulations and rules, as well as these Measures.  

Article 3   An organization to be entrusted with imposing the administrative penalty shall meet the following conditions:   

(1) to be an institution in charge of public affairs established in accordance with law;  

(2) to be staffed with personnel who are familiar with relevant laws, regulations and rules and are experienced in the work; 

(3) to have the conditions for organizing and conducting the technical tests or technical appraisal that are needed for testing or appraising illegal acts; and  

(4) to meet the requirements on the functional tasks of institutions as specified in the reform of institution classification.  

Article 4   An entrusting body who applies for entrusting the imposition of administrative penalty (hereinafter referred to as entrustment) shall submit the following materials to the legal institution of the people's government at the corresponding level:   

(1) an application for entrustment; 

(2) the legal basis for entrustment, such as laws, regulations and rules (incl. these Measures); and 

(3) relevant evidence supporting the legal conditions of the entrusted organization.  

Article 5   After the planning department of the legal institution of the people’s government at the corresponding level gives its consent to the entrustment, an entrusting body shall sign a Letter of Authorization for Entrusting the Imposition of Administrative Penalty (hereinafter referred to as the "Letter of Authorization", with a sample attached below) with the entrusted organ or organization, and shall, within five working days as of the signing, submit the Letter of Authorization to the legal institution of the people’s government at the corresponding level for the record.   

A Letter of Authorization shall specify the names of the entrusting body and the entrusted organ or organization, the entrustment basis and matters, the scope and term of authorization, the legal responsibilities, and other contents, and shall be publicized.  

After the entrustment herein becomes effective, the related imposition of administrative coercive measures shall not be entrusted.  

Article 6   The administrative law enforcement officers of an entrusted organ or organization must, before assuming office, receive training on public and professional legal knowledge, participate in and pass the qualification examination for law enforcement officers organized by the Province, and obtain the law enforcement certificate.   

Article 7   An entrusted organ or organization must, within the scope of authorization, impose administrative penalty in the name of the entrusting body and stamp the administrative seal of the latter. The entrusting body shall bear corresponding legal responsibilities for the consequences of the imposition of administrative penalty by the entrusted organ or organization within the scope of authorization.    

An entrusted organ or organization may not further entrust any other organ, organization or individual with imposing the administrative penalty, or impose the administrative penalty beyond the scope of authorization; otherwise, it shall bear corresponding legal responsibilities for the consequences of the imposition of administrative penalty beyond the scope of authorization. 

Article 8   An entrusted organ or organization shall undertake the specific work for administrative reconsiderations or response to administrative litigations incurred by its imposition of administrative penalty within the scope of authorization, and its functionary-in-charge shall plead in court in accordance with the relevant requirements of the Interim Provisions of Wuhan Municipality on the Court Appearance of Functionaries-in-charge of Administrative Organs (Order No. 261 of Wuhan Municipal People’s Government). An entrusting body shall timely deliver to an entrusted organ or organization the relevant legal instruments and materials of a reconsideration organ or a people's court.     

An entrusted organ or organization shall report to the entrusting body on a timely basis the major cases of administrative reconsideration or administrative litigation. Where the court appearance of the functionary-in-charge of the entrusting body is really necessary, an entrusted organ or organization shall submit a request thereby, while the functionary-in-charge of the entrusting body may not refuse.  

Article 9   During administrative law enforcement, an entrusting body and an entrusted organ or organization shall reinforce their cooperation and collaborationexchange their information, and coordinate to solve the problems arising therefrom.  

Article 10   An entrusted organ or organization shall report to the entrusting body its imposition of administrative penalty semiannually; and the latter shall reinforce its guidance and supervision over the imposition of administrative penalty by the former, timely provide the information on the establishment, amendment, abrogation and interpretation of relevant laws, regulations and rules, and offer it and its law enforcement officers consulting services.  

Article 11   Where an entrusted organ or organization imposes administrative penalty in an incorrect way or beyond the scope of authorization, the entrusting body shall order it to make corrections, or if the circumstance is serious, suspend or revoke the entrustment. The revoke of entrustment shall follow the procedures for entrustment.  

Article 12   The legal institutions of the Municipal Peoples Government and the peoples governments at the district level shall supervise and examine the entrusted imposition of administrative penalty and correct the problems found as provided by laws and regulations.  

Article 13   For the entrustment of law enforcement in administrative collection and administrative supervision and inspection, the provisions of these Measures shall apply.  

Article 14   These Measures shall come into force as of July 1, 2017.

3. The Entrusted Party shall accept the guidance and supervision by the Entrusting Party; 

4. The Entrusted Party shall exercise the entrusted power of administrative penalty according to law, and may not impose the administrative penalty beyond the scope of authorization; otherwise, it shall bear corresponding legal responsibilities for the consequences of the imposition of administrative penalty beyond the scope of authorization. 

5. The Entrusted Party may not further entrust any other organ, organization or individual with imposing the administrative penalty;  

6. The law enforcement officers of the Entrusted Party shall attend the training on ideology and politics, professional knowledge and legislative operations organized by the Entrusting Party;  

7. Where the Entrusted Party exercises the entrusted power of administrative penalty against laws or disciplines, the responsibilities of the persons-in-charge and the persons directly responsible of the Entrusted Party shall be investigated in accordance with laws and regulations.
